Relief from abusive husband

For 22 years I have tried, inspite of in-laws harassment, husband's abusive behaviour and mental torture and humiliation. Mainly because of not being financially capable of supporting myself and my two daughters. Today I have a capacity and means to look after all this and just want an equal share in my husband's property for my kids. My husband does not change his abusive behaviour and does not want to let go of me too. What options do I have if he insists on living with me.

A.You can file for divorce on the grounds of cruelty and irrevocable breakdown of the marital relationship. You can also file a complaint with the police under S.498-A of the Indian Penal Code for the same. During the course of proceedings, you can claim interim maintenance from him under S.125 of the Criminal Procedure Code.
You children will have equal rights over your husband's property as they are both his legal heirs.

A.Sorry to hear this though.Both the kids have all legal rights to get thier fathers property.Moreover wife has the legal right over legaly wedded husband. Nothong to worry about the domestic violence. Get a protection order from court he woudnt be dare to touch you anymore. Find a good lawyer and he will deal it very smoothly.
