I don't see any risk in the rental agreement unless I have seen the agreement.
As long as you are not occupying the flat so the occupant should pay the maintenance.

Even if your brother in law has made the payment but the flat is registered in two brother's name hence it will be considered that it is their self acquired property. IF they willingly allow your name to be registered then only you can get the right or else you need to knock the door of of the court.

In my opinion the single power of attorney might not be a good thing as the flat is still no owned by him so ideally he cannot give power of attorney for something which does not belong to him. If you have PoA from all the landowners then you get the right to sale their flats too.
