A. Dear Client,

icon Property - we are planning to buy one flat

we are planning to buy one flat where builder has not formed society yet from last 20 years. Owner had registration and all clear docs but only society not formed. is it safe to buy this flat

A. Dear Client,
Without being satisfied yourself with the experiences facing by the co-residents of the said building who have been living there for a long time without forming any society, it may not be a wise decision/plan to buy a flat in the said building which is run by Builder since 20 years without forming any society. A society of residents registered under the relevant Act ensures the protection of common interests/benefits and security to the residents of the Building.

A. Dear Client,

Make out a General Diary at the local Police Station against the concerned relatives for harassment and mental agony for their illegal and malicious demands and reach out to an Advocate for guidance and steps. Further, your mother can file a complaint against the concerned relatives for physical and emotional harassment to the District Legal Services Authority or Sub-Divisional Legal Service Authority for desired relief in the matter.

icon Granddaughter right on grand fathers property

Hello Sir, In 1972,there is a agricultural land which was jointly owned by person named A(aged 60) and his son B(aged 5). From 1972 to 2003 , this land was used by A and B only for agrictularal needs

A. Dear Client,
As you are mentioning that the land is the self-acquired property of A, he becomes an absolute owner of his share of property, therefore he has full rights to sell his own property, his sale of property without the consent of his children is very much valid in the eyes of law.

Therefore no case to recover the sold property is maintainable nor tenable under the Hindu Succession Act

A. Dear Sir,
You have to get modified the said two wheeler parking into four wheeler parking place. Normally, you cannot be prevented from using two wheeler parking place for parking four wheeler. If anyone object then you can file a simple suit for permanent injunction against the concerned including executive members of the Housing Society.

A. Dear client,

Back when your father bought the plot, he would have signed a sale agreement or something of that sort, this document will help you prove that the land is originally yours and illeglaly being occupied. These papers can be used as evidence in court to support your claim, there is no necessity to track down the new owners etc, just find the documents that support the fact that your father bought that plot of land.
