PG owner shows his might.

Rent was 6k. He took half of the rent as advance, & said that 1k will be for maintenance, and left over will be refunded while evacuating. After 4 months at the end of june I had an emergency, I took flight on 4th of July. I asked for security amount to be refunded, he refused & asked 4 days rent of july too @Rs 500/per day. When I refused, he locked whole PG to not let me evacuate. What should I do???
A.I have gone through your query in detail.
1) Sir you have not mentioned from which state, city and your location of rent....
2) You should have told him to refund of security deposit amount and to deduct the 5 days rent of July which he demanded.
3) But in your case the leave license agreement or the paying guest agreement has to be reviewed about the clause or Notice period etc.
4) Legally he cannot lock the PG and cannot avoid you from taking your things back.
5) if there is no record of what things you have left behind OR if there is NO CCTV camera take a good political or social worker support and file a case of 420 and missing items such as laptop, mobile etc., also keep the Bills ready to show from your friends of such items handy & teach him a lesson. You should have first removed all the things from your room & then demanded your Deposit refund.

A.My understanding as per the facts given by you is; 3k was security and 1k out of that would be deducted, then remains 2k. Refused for the refund of the security amount of 2k and in turn asked you to pay Rs. 500/- per day for 4 days which is 2k. Now, firstly, the payment part gets settled by this; and secondly, as regards your belongings, talk to him and if he still doesn't allow you to take, then call the local police and worst file a complaint against him.

A.Call police . He can't confine you like this. First of all she should set you free. Secondly it is not clear about any notice period. In default of notice what will be the procedure. If there is no such condition she is bound to pay back the money. If she doesn't pay advance she can't ask for 4 days amount of rent.
