A.If you and your wife are legally divorced by a decree of divorce and period of appeal has been expired then you can remarry a second marriage. The allegations levelled by wife amount to cruelty on the basis of which you can file divorce case on the ground of cruelty. Without dissolution of first marriage by a decree of divorce by court you cannot remarry.

A.No, you will have to contest the petition and face the trial in which you can surely prove that the allegations are false. However, you must go for S.9 Application for restitution of marriage.
