Adoption of my niece Adoption of my niece

Hi, My sister and her husband passed away in 2013, left behind a daughter who was 4 years then, she has been with my husband and me ever since.

My sister's mother in law is not at all financially stable, she has an elder son too who is upfront in saying he doesnt have the capablities to take care of my niece.

The mother in law is not ready to let us adopt our niece who is as good as my own daughter even though my niece has been staying with us since 2013. Now she is 12 years old and I need to get her documentation done, I do not want to go to court and file a case against the mother in law but want to find out a way possible without the case.

Any suggestions??
