Division of mothers ancestral property Division of mothers ancestral property

My grandfather died in 2001 and had made a will and gave 5 acres of land in her name via gift deed.. my mother's brother's took equal share in the property ... Now as per the new supreme court judgement a daughter is treated as son and hence equal share need to be given is quoted.. hence according to this equal share is to be awarded... My mother doesn't want to get into quarells..so can I file a case as legal heir on my mother's father's inherited property...
