Negligence with respect to animal

A resident in my society has a vicious large dog of Akita breed. This morning when my servant was walking my small Pug, the Akita was being walked by the walker they have employed. The Akita confronted my servant and he fell back on the road and the Akita then freed itself from the walker and attacked my dog causing deep bites and injuries to my dog that require medical attention and treatment. I am a first-year law student and through my research, I feel this would fall under Section 289 of the Indian Penal Code (Negligent conduct with respect to animal).
