Sir Hmare against FIR hui thi US/323/325/341/34 jinhone FIR karwayi unse hmara settlement ho gya aur deed b bn gyi but IO chargesheet nahi daal rahe bol rahe h 1 month aur lagega tb chargesheet jayegi pls guide hum chargesheet toh ese settlement base k badle criminal base pr daal dege IO pls help hm high court nahi jana chahte quashing k liye costly hai pls help

As per your inputs it shows that there was a settlement among you to settle the matter, then better convey the same to the trial court by filing a memo by both complainant and the accused then the respected judge will referred the matter for lok adalat for settlement. No need to wait for the chargesheet as complainant is agreed to with draw the case against you

You can approach the High Court for quashing of FIR and if you do not want to take that route then you can wait for the IO to submit the chargesheet.

A.If you don't have much time, file case for quashing of FIR in High Court.
Otherwise wait for chargesheet.

Section 323, 325 & 341 of IPC are compounded offences as per section 320 of CrPC and may be compounded by the person to whom the hurt is caused, the person restrained or confined after permission of the court.
The complainant and accused jointly have to file an application under section 320 of CrPC before the concerned Ld. Magistrate Court.
