Firm formation

Hello
My father in law is class 1 PWD contractor..now that his two elder sons have completed education and worked under him for2 years want now to settle by forming firm what all legal requirements are needed to form a firm in which both the sons and father can run the business ?how will it be beneficial and what are the risks ?
