Smoking in public

I was caught smoking in public place however, they have no picture of me smoking, the police had taken my phone forcefully where i was on a call with my girl friend, he spoke to her without asking me telling her i was caught smoking. She asked when did this rule start and the police constable got offended.
Later i was taken to the police station where the inspector was asking for a picture however they didnt have one, still the constable went on and had filed a petty case against me. Took screenshots of my whats app messages with my girlfriend where she asked "why the fuck are they doing like this", not knowing the meaning they all thought that it is abusing police. And they told me all negative things about her and talking cheap about her. I was helpless all this while and afraid of what they would do to me taking those screenshots. I have been asked questions such as what is my caste, what is my father's occupation which had no reason at all. They have made fun of my attire in an insulting way, no one abused though. What can i do in this case, should i fight back? Bcz i feel mentally harrassed. Please advice

As per the facts stated by you, you may file a complaint with the higher officials of police against the police officer who mentally harassed you.
Any victim of police abuse can register a First Information Report(FIR) against the police officer at any police station;
If his complaint is not accepted, he can send complaint to the District Superintendent of police who will then look into the matter and order the registration of the FIR .
However, for best advice, more facts are required.
