Can Maharashtra police arrest a person by tracking him through his mobile no. location?
This person has cheated lot of people with false promises of job, flat and many such things. Can police arrest him based on the 420 FIR only? Can we get our money back through only FIR or do we need to go to court? If this person says that he doesnt have any money with him, can his property or anything belonging to him will be sold and money will be recovered? If he isnt able to pay anything, what will be the punishment for him?
What are the steps to be taken in this matter?

A.Hi,
You can go to the court for recovery of money by selling his property. The police can choose to track his location via his mobile. And the punishment for Section 420 IPC, will be a maximum imprisonment for 7 years with or without fine.

A.Hi,
Yes the police can track him via mobile if they deem it necessary and yes he can be arrested under Section 420 IPC. The punishment will be imprisonment for maximum 7 years with or without fine. You can approach the court for recovery of money by selling his property.

A.the only FIR itself goes to court automatically.
if police wants then it can arrest through mobile no. location
if he doesnt pay/appear/absconds; the lawyer will help in attaching the properties to recover money.
in 420 The maximum punishment which can be awarded is imprisonment for a term of 7 year and fine..
