My wife left my home two months ago, because my mother and I don't agree for some family occasion, We are in 1.1yr in marriage and 1 month ago, we blessed with a baby boy! Now, after discharge, she didn't reply to my call properly and after some days, she won't replaying and not answering my messages. When she left home, she went by saying, won't come home again, so two months back I filled section 9 case for coming back home,
No violence ever happens between us, no dowery asked, so
My question whether she file a false case of 498A or DV act against me, if yes, can she prove it, when nothing happens,
And the second question whether section can give some liberty against the case filed by her.

A.hi,
you will be guilty only when thigs are proved.

A.Hi,
anyone can file anything or charge someone for any act but you will be held liable for the act only if the act is proved.
yes, if the accuses, you you can justify youself. you must have evidences to prove that you are right

A.she can file a false case of 498A or DV act, its her right.
you have to answer that how she prove it, when nothing happens ?

you can take anticipatory bail and then contest the case. she have to prove the charges.
