I want to file a civil case for recovery of my money paid through bank transactions.
Also I want to file a criminal case for cheating & causing me mental harassment & difficulties, because some people who took money from me for some purpose have failed to do the same and also not returned my money and are absconding now.
Is this ok to file both the civil & criminal case, one after another or at the same time. One for recovery & other for punishment, so that those people will not dare to cheat any other people.
A.Yes, you can file both cases at the same time, but in their respective Courts.
A civil suit for money recovery under Order IV of the CPC must be filed within 3 years of the incident. An FIR can be lodged at the local police station under S.420 of the IPC, which deals with cheating and fraud.
