I am a student ,my case going in district consumer court Ghaziabad uttar pradesh .sir i am not comfort in English so please try to understand my wording.
sir 2011 I have taken admission in a private iti institute. subject was civil draftsman course was two year and i have paid 35000 Rs Fees to institute.but till date institute did not give me my iti result or not return my two year fees 35000 Rs. so Feb 2015 i have filed complaint against institute in District consumer court ghaziabad uttar pradesh. but till date district consumer court did not give any judgement in this case. i am living in delhi. i have no job so i have to face financial problem. ghaziabad court is so far from my house 350 Rs i have to pay as conveyance.
so please tell me can i transfer my case district consumer court ghaziabad to ncdrc national consumer court. new delhi and if yes please tell me what is process.
A.NCDRC has power to transfer any pending case from one district forum of one state to another district forum of another state. Therefore file a Transfer petition before NCDRC for transfer of case from Ghaziabad to Delhi and if NCDRC refuses to transfer, then u can challenge that order in supreme court. For Supreme court case, u can get advocate free of cost at state expense from Supreme court legal services committee, chamber no 108-109 Post office block.Supreme Court compound Supreme Court of india Tilak Marg, New Delhi.
If both the places are withing the same state then they can be transferred by approaching High Court othersiwe3 you have to approach the Supreme Court. It will be tried only in District Forum of Delhi. You may approach Legal aid services Delhi High Court for free advocate.
