Regarding Full and final statement

As per company employee handbook there was a paragraph earlier that Leave encashment will be calculated. But after Covid situation that paragraph was removed from Employee Handbook. But in Full and Final it is mentioned that " In the Full and Final settlement all employee benefits such as Leave salary, gratuity (if applicable), medical reimbursement or any other amount due to an employee over and above his/her salary would be calculated." Can a legal action taken and I will be able to get my Leave salary.

A.Hi,
If it has been removed from the terms of your employment contract, then you cannot claim the amount. The best course of action is to formally approach the management and make a request for the same.

A.Hi,
If it has been removed from the terms of your contract, then you cannot claim the amount. You may however, appeal on the grounds that the leave encashment was what prompted you to accept the job in the first place.

A.Waste of money if you are a company employee. Instead give up the money as legal expenses will be more.
