WE WERE PROMISED BY BUILDER TO HANDOVER THE PREMISES IN 2018, HENCEFORTH WE SECURED LOAN FROM ICICI BANK AND PAID THE AMOUNT TO BUILDER . TILL DATE THE PROJECT IS INCOMPLETE AND WE HAVE BEEN PAYING EMI s. PLEASE SUGGEST WHAT ACTIONS CAN WE TAKE UNDER RERA

A.Hi,
As per section 18(1) of RERA, in the events where the promoter delays the possession of a property or fails to complete the project within the agreed time as mentioned in the sale agreement, he shall be liable to return the amount received from the buyer in respect of the apartment/property or plot, along with the due . You may send the builder a legal notice regarding the delayed possession.

A.Hi,
A buyer can file a case and send legal notice to the builder for delay in possession under the RERA Act, 2016.
