DVC Case Details DVC Case Details

Hi Sir,

I have two questions.
1) If the dates and points mentioned in the DVC copy which is sent to police station and the copy that is sent to the court, contains a different date of
voilence, different quantity of Ornaments given, different people as proof (Person A & Person B in the copy given to police under DVC and Person A & Person C as witnesses in the petition given to the court ) with 8 differences listed, can it be proved that it is a wrong DV case as filed by my wife ?

2) In a DVC case if the Domestic voilence date itself is not mentioned, I am thinking the DV Case is Invalid. (My Friend's case). His wife writes he bet her, blue and black, but doesn't mention DV Date. If date itself is not mentioned how come a DV case is valid ?
Please advise.

A.Hi,
1. This will depend on whether this evidence outweighs the other evidence. If the case is false, she can be punished under S.209 IPC.
2. The complaint would be valid so long as it has been made to the police or a Magistrate. There must be some error in the printing, you can get this issue resolved in Court.

A.Hi,
1. You will have to prove beyond reasonable doubt that you did no wrong, this evidence can help you substantiate that.
2. There must be some discrepancy at the Court about this, you can get more details there. The complaint will be valid if it has been made to the police or directly to a Magistrate.
