Hi, last September I did sale deed for my omni bus. The buses are under finance.total sale value is 2900000 for 2 buses. In agreement,, they gave 110000as initial amt, and balance amt they paid to the finance by monthly emi. If they can't paid the due, I took the buses after 45 days. And they need to give 8000 per day for both buses. From March onwards they didn't paid their dues. And taxes for buses. So I took my buses on November 2020.but I didn't give any notice. I told through mobile communication. Now they filed the case against me like theft for getting more money.I didn't give back their money. Because it tally with money what they need to give. This sale agreement was not notarized one. What to do for this. Can u pls give solution.

A.Hi,
This will depend on the terms of your contract. If you had a right to recover your vehicle in case of non-payment of dues, they cannot lawfully ask you to repay them. If you found this helpful, please rate us.

A.Hi,
This dispute can be settled depending on the terms of the contract. If you had the right to reclaim the bus when they were unable to pay, they cannot expect you to pay them for it.
They can be punished under S.209 IPC for making false claims.
