We found PoA of property of 1974 in my grandfathers name we get to know later that the house built there was broken down by govt during 1975 emergency .Still there is nothing constructed on the land is there anything we can do?

A.Hai,
You will not be vested the good title over the property just because you possess a power a attorney. If a person dies, POA automatically get terminated on death of executant or person in whose favour POA was executed. The laws governing contracts and power of attorney in India are not self-explanatory when it comes to revoking power of attorney. Hence, it is up to the courts to decide upon the same. A.Hai,
The laws governing contracts and power of attorney in India are not self-explanatory when it comes to revoking power of attorney. Hence, it is up to the courts to decide upon the same. So consult a lawyer to know the procedures. If you found this helpful, please rate us.

A.POA does not create any proprietary or ownership right. POA automatically get terminated on death of executant or person in whose favour POA was executed. The nature of land and order for demolition are required to be examined.
