I want to buy a land. Land owner has given power of attorney to her husband in year 2004 for selling the land. Can I purchase it ?

A.Hi,
If the wife's Power of Attorney grants her the power to sell, then you can go ahead with the purchase.

A.Hi,
If she is empowered to sell the property as per the terms of her Power of Attorney, then you can go ahead with the sale.

A.If the Power of Attorney is a registered document the clause has been clearly mentioned regarding sale of the property the attorney can sign then only then the document will be admissible by Sub-Registrar where you will require to register the Agreement in respect of the property and you can purchase the property. However I shall advice you to get the Power of Attorney document reviewed by a lawyer and simultaneously all other documents to ensure the title of the property is clear. Thank you.
