At the time of processing of travel card amount an error occurred within the bank and instead of crediting of CAD $ 856 in travel card erroneously credited CAD $ 43808.62 in this way the bank has mistakenly credited CAD $ 42952.62 as surplus CAD$. My brother was away in canada at that time. The bank filed an FIR under section 420/406 and Civil Suit. The FIR was canceled after few month by the police. But not by the court. The civil suit is in process. Is my brother eligble for an PCC? What will be the process to get the FIR canceled by the court? Will bank be able to recover the money in the end? I have various other questions in this case. Looking for a Civil and Criminal Lawyer who has expertise in Financial & Banking cases

A.Hi,
Your brother has a duty to return the excess amount as it is not his money.
However, it will all depend on what can be proved in Court, we can assist you with this.

A.Hi,
We can assist you with this, but we will need more details about the facts. The case can be quashed if an application is made to the High Court under Section 482 CrPC.
