We live in joint family .our house is divided into three portions .our own portion is in the end .my father's elder brother left his portion and after 15 years they sold it to the other brother without our information even knowing that they could harm us or our property in a direct or indirect way.they had even threatened us .... What could we do ? Also can we also sell our portion seperately to anyone elese ?

A.The Partition Deed is required to be scrutinised thoroughly. If the terms and schedules are clear, you would be able to sell your portion separately.

Actually the partition is done by the grandmother casually . Each brother had two rooms in lower portion .we had built two rooms on first floor and the eldest brother also built two rooms having a common stairs to the first floor.Now the second brother bought the other portion both on ground floor and first floor without our acknowledgement.they had threatened us that they will enclose above portion in which the common stair lies.this will force us to bulid a new stair from ground floor to reach above .

In that case it might be better to file a suit for injunction.
