My landlord has been causing us lotsa prblems. We have paid rent on time everytime. Now he says he wants apartment for his family to live but I also found out he wants to rent for a higher amount so I asked him for an affidavit confirming he wont rent it out to someone else but he is not willing to give. What are my rights? Can I refuse to leave and keep paying rent on time? Can he evict me without a court notice through society or police?

A.Hi,
You can stay there until the rent agreement expires. You cannot compel your landlord to sign ay affidavit as it is his property. We would suggest arbitration or mediation to come to a compromise.

A.Hi,
You can stay until the expiry of your rent agreement, unless you violate its provisions. As the landlord, he has the right to demand whatever rent he deems appropriate. You cannot compel him to sign any such affidavit as it his property, he can do with it what he pleases. We would recommend arbitration or mediation.

A.If you are a tenant and paying regularly and not flouting any provisions of local rent laws then the Landlord would not evict you without due process of law for which he would have to file eviction suit against you with reasons to be proved therein. And of course you can defend the suit which ultimately give you more than sufficient time either to settle amicably or make alternate arrangement. A.You cannot ask him to give an affidavit that he would not rent it in future ,it his property and he has every right to give it on rent to anyone he likes.If he has a bonafide need of the property he hasfull right to get you evicted .He will definitely have to give u a legal notice of eviction through a lawyer if he wants to evict u give u sufficient time to make alternative arrangements ,and he has a right to go to court also.Try to settle the dispute amicably and search for another house as per your pocket .Do rate me if advise is helpful.

A.He cannot evict you out of the house if your rent agreement has been registered till such time which has been specified in the agreement and if he tries so you can file a case against him under Rent Control Act or a police complaint for criminal breach of contract and using force against you.
