Employer not giving reliving letter

since 4 months my salary is stopped and all my access to company including my office e-mail access are revoked, now my employer doesn't want to either process my resignation or issue termination letter, if i have job offer from new employer how can i join without relieving letter? is there a way i can get some go ahead from labor court and join new company? even if i file case after serving legal notice it would take very long time.

A.Hi,
Firstly, You need to send the legal notice to the company, if they don't respond within the prescribed time, then any further legal action should be taken. If the company agrees to give the letter, then no need of taking legal action would be left.

A.Hi,
Yes, you can send a legal notice to said company and can take legal action against them in the labor. No, it would not take much time. If the company agrees to settle the matter, then you wouldn't have to file a suit, sending legal notice would be enough which will hardly take 15-30 days.
