In the month of March 2020 police seized my two wheeler because because I am carrying liquor from telangana state. Police sent a notice to pay ₹20,000 in the form of FIX DEPOSIT RECEIPT and take back the vehicle. Accordingly i paid it and followed due procedure and got my vehicle. Two days back police called me for inspection and I went to the PS for the same. After going to PS , constable took away the key and told me that your vehicle shall be put in auction and participate in the auction if you want your vehicle. My question is whether the police is correct in doing so even after I paid ₹20,000 as penalty ? What are the rights i have now to get back my vehicle. Note :- vehicle gone to someone in the auction. Now what kind of action can i take on police ?

A.Dear Sir,
You can file a civil suit against police for their illegal work and exceeding their power with the help of an advocate. Police are allowed only to ask you to pay penalty or can give you court orders to give your keys for auction. You can get back your vehicle through this.

A.Dear Sir,
Police can either ask you to pay penalty and take back a vehicle or can give a notice of auction that also by the order of a court. Police have no right to do both of things together. You have right to file a civil suit against the police in charge for exceeding their power. Best option is to get an advocate show you all documents and notice by police and file a case as he suggests.

A.The police cannot either ask you to pay or auction your property without the order of the court unless it is of perishable nature. I think the matter needs to be probed and I would recommend you to meet a lawyer immediately in person and show him all the papers relating to this incident in order to understand the real nature of the action of the police.
