Wife found guilty in sec 125 and rcr sec 9 as she provided false information to hon. court and filed out of jurisdiction cases at family court and executed it for long 5 years. Now court said that she may undergo legal remedy as per law if so advised. What is Legal Remedy under law for filing false and out of jurisdiction case on false information and cheating the Court.

A.Hi,
If the court doesn't have jurisdiction to try the case, the case will be returned to the competent court. The Court can make a compliant against the wife under Sec. 340 CrPC.

A.If your wife has filed the case bonafide in a court of incompetent jurisdiction then she is entitled to file the case afresh in the court of competent jurisdiction and it was your duty at the first instance to object to the lack of jurisdiction of the court. The case can only be termed as false when you are not found guilty and then you file a counter case against your wife and prove that your wife has made a false case against you.
