Legal Notice received by the bank on my property for non payment of six months

Received legal notice as to put on auction my property , Bank had not taken proper initiative to process my approval request of my EMI after moritoriam period in the last year 2020 due to my financial crisis. even though i have started paying EMI from last two months.
A.You have to reply to that Bank `s notice. Also, you better meet that Bank`s manger once to seek some time to you to regularise your loan.

A.since you started paying EMI then its good.
send reply notice so they stop auction. this reply notice will help in DRT / HC to get relief if required.

A.बैंक से सम्बंधित विवाद sarfasi act के अन्तर्गत आते है।इसके लिये अलग से DRT कोर्ट खुली है।वहां पर आप नीलामी से समन्धीत notice को चैलेंज कर सकते हैं।सिविल कोर्ट कोई क्ष्तेरधीकर नही है।

A.Bank might have issued two notices under section 13 of SARFAESI Act before sending notice for auction. Under SARFAESI Act since civil court does not have power hence approach Debt recovery tribunal. Pendency of your proposal does not restrict bank from proceeding under SARFAESI Act.
