Employer laid off from job and didn’t inform.

Employer didn’t inform anything, After lots of follow up with HR, he told on 27 th April that 30 th March was last day. In resignation letter they mention that I had resigned but its not true. I have not received 30 days notice too.
How much will it cost for filling law suit?
What will be the process?

A.You are saying they terminated you .
but HR is saying that you resigned. so they are forging your signature ?
If yes then you can file FIR.
If they terminated you then you can challenge it and you can easily get job back.

Employment issues are generally resolved as per the terms of the employment agreement. However, if the company is terminating you without notice then they will generally pay you advance salary and severance. Since you were terminated in an unfair manner you should first send a legal notice. If the company does not comply with it. You can approach the labour commission and later file a civil suit. As far as the expense of filing a civil suit is considered, it will vary according to the length of the drafting, the collection of evidence, research on your topic, searching of case laws, merit of your matter, only then an estimate can be gathered.
Consult a local lawyer and then make a decision.

It is evident that there has been wrongful termination and therefore you should first send a legal notice to the company and then approach the Labour Commission for remedy of wrongful termination. You can also file a civil suit to get compensation but the expenses incurred in filing a civil suit depend on the issue and the court fees. The lawyer charges you for research done and collection of evidence and all drafting work involved in the suit. Therefore, there is no definite answer to that.
