Harrassment by Manager by pulling my hand, giving bad performance ratings , Threatening me that he can fire me from job and doing partiality and biasness. Although i approached the higher management but they suppressed the matter and telling me take in a positive manner

A.Hi,
Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013, to provide protection for the working women against sexual harassment only. Therefore, if there is any harassment that is sexual in nature then you can file a complaint under PoSH Law. Wage cuts and over time can be dealt with legally but for threats and bullying, you will have to approach higher authorities or internal committees or HR.

A.Hi,
If you are being harassed sexually you have remedy in form of PoSH laws, But for cases of bullying and harassment, HR or internal committees only can deal with the issue. However, in several cases courts have recognized that such bullying could lead to serious mental health issues which could be legally dealt with. Therefore, any concrete remedy in the form of legal notice or other legal measures can be only provided after the facts are proved in detail.

A.there is a saying - a grain can be made mountain.

pulling hand once, threatening from job , partiality and bias are not sexual harassment. for every excuse, you can not claim sexual abuse and then enjoy by not working.

Because of fraud people like you who misuse law, the real victims dont get proper justice.
