Delay Penalty

Sir i got RERA Verdict vide Delay Panelty calculation as follows-

It says Promotor will give DP @ mlcr +1% to me
and If
According to RERA clause 2(za)(i) if for any default pramotor charged customer for whichever Rate of Interest ,the customer is entiled to get the Delay penalty with same ROI.So for delay payment customer will also pay at mlcr+1.

Builder charged me @12% for delay in some installments before and after commencement of RERA as well. Also i had paid 95% payment before Offer of Possesion.

So now confusion is on what % i will get DP--- on mlcr+1% or @12%

when i asked legal team of builder to pay at 12% they said following statement-

"Kindly take the ref of our previous meeing n discussion in which you asked for the compliance of RERA order point no-03,in this regard we wish to inform you that the managment is never denied.Your ROI and Delay Penalty ROI will be same.
As you are aasking about 12% in your email this is to inform you that your booking s from July 2014 before commencement of RRA on that time this was applicaable"

Sir kindly let me know if i am asking for someing wrong or i am right.
