Deduction in Provident Fund Deduction in Provident Fund

I joined HCL- Noida company on 24th July 2006 and left the job on july 03rd 2011. As I left the job 15 days ago before completion of 5 years company made a deduction of INR 25,000 in my PF. HCL had its own PF platform which was not associated with government. Is that right...? Do I need to claim that amount back by HCL which they deducted.

A.Hi,
While it is legal for HCL to have its own PF website, it is no longer mandatory for all employees to contribute to the Provident Fund. Employees with a basic salary of more than $15,000 have the option of opting out of PF, but only at the time of hire. Deductions from your PF account are largely dependent on Company Policy and your employment agreement, so any concrete legal recourse can only be provided after reviewing them.

A.Hi,
It is legal for HCL to have its own PF platform but now it is not compulsory for every employee to pay Provident Fund. Employees having a basic salary of more than 15,000 have an option to opt out of PF, but only at the time of joining the company. Deductions made in the PF account are solely based on Company Policy and your employment agreement therefore any concrete legal remedy can only be given after going through them.
