My father passed away when i was 12 since then i and my family are staying with my grandmother (mothers mother).my mom has 2 brothers one is elder brother who got married and the other brother is younger to my mom. my uncle who is elder to my mom who got
job after his father death & doesnt take care of my grandmother and his brother who is jobless at all so my mom is looking after her and now he and his wife along with her family are harassing us daily with abusive words and threatening us &giving a false alligation that we are staying with my grandmother for her property for which we dont have a right itseems my grandmother doesn't want to live with him becz she fells that she has treat with themi would like to file a complaint plz advice

if yes then Your mother and grandmother have equal right and share in the property with both brothers.

The property was on grandfather name ?
if yes then Your mother and grandmother have equal right and share in the property with both brothers.

First you should file FIR against your aunt and her family for harassment. Then your mother can ask for partition in property under Hindu Succession Act and your mother has right to stay in that property with her family.

As per Hindu Succession Act your mother is part owner in that property you are living in and can ask for partition in the property. And for the harassment you can file FIR against them.
