I am a loan freelancer, i provide a mortgage loan to my customer and before login i informed him about my commission. Loan got disbursed on 8th march 2021 and on 9th march i asked him for my commission but he denied to pay but after many request he pay only 50% and i closed the deal .after 20 days bank sales man informed me that customer has not pay his feb month pre emi and i asked to customer on 28 th march why he didn't pay this so he denied to pay the same, after 2 month 24 may he told the collection executive that i have taken the pemi in cash. He claimed that those 50% commission is pre emi . What shold i do he is trying yo cheat me. Help me

A.Hey,
This is breach of contract that you had with your customer from his side and also fraud by him to not pay pre-emi of the loan. You can file both civil and criminal case against him. But first try to have an amicable solution to your problem through arbitration method as that is less time consuming.

A.Hey,
You should draft a legal notice with the help of the lawyer enlisting all your grievances with customer and non-payment of your fees. And if the matter is not solved amicably with notice then you file complaint for fraud with police and a civil suit for damages in civil court.

A.The fees have to be collected after approval and before disbursement.
How you told abt commission ?

you dont do anything for now.
let bank take care of him.
he cant do anything to you.

A.Can he prove that the cash paid is the pre-EMI? No. What he is supposed to pay you has paid you and what he is supposed to pay to the bank/FI as EMI has to be paid directly to the bank and not an agent. He is trying to frame you and trap you after taking the loan so just ignore him.

You have done your job of helping him get the loan and if he is not paying it back then it is his problem and the bank has to deal with him.
