My father had a little FD before he died. After death, my brother taken signs on the bank paper to take the FD's money and promises to give equal distribution. But, now more than a year has passed but he is not paying the money. And said that when I pay at that time you have need to sign in front of the judge for their evidence Is this the right procedure?

A.Hi,
Nobody can steal what is properly yours until your father has declared your brother the complete owner. Please investigate who is the candidate for your father's FD funds. He just serves as a custodian, ensuring that the deposit reaches a legal heir. When a depositor dies, the nominee has two options. Keeping the FD till it matures is one possibility.

A.Hi,
Nobody can take what is rightfully yours unless your father had made your brother the full owner of the property. Please find out who is the nominee of the FD money belonging to your father. He simply acts as a custodian and makes sure that the deposit must reach a proper legal heir. The nominee has two choices upon the death of a depositor. One option is to keep the FD until it matures. The second option is to remove it right away. Banks will not charge any fees if you withdraw money. There is a lot of paperwork that has to be taken into consideration kindly talk to a lawyer.

A.I don't think this is the right process. The bank will pay the money the nominee if there was one or else it will ask to get a court order to whom the money is to be paid.

A.Aap ke father dawara ki gai FD me nominee bhi kiya gaya hoga. Yadi aap ke bhai ko nominee kiya gya tha to vah sirf us money ka care taker hai. Absolute malik nhi hai. Usko use karne ka right nhi hai. Uski duty yah hai ki vah ukt money ko nikal kar uske legal successor ko de de. Yadi nhi deta hai tab aap court me apne bhai ke khilaf money recovery suit file kar sakte hai. Baaki aisa koi niyam nhi hai ki judge sahab ke samne dene pdenge. Galat bol raha hai.
