I am about to finalize a flat in a new upcoming society, on rera website i checked it shows that there is some litigation issues pertaining to the land on which that society is built. Sales people of that project told me they are nowhere involved in that case. I am confused, whether should i buy that flat? how will it affect me as a homebuyer in future.

A.Dear Sir,
You are not only purchasing the property but also litigation. Always the sales people wanted to mislead prospective buyers. You may approach other developers to get clear property without any litigation.

A.Don't purchase the property because tomorrow if any adverse order is passed than the liability will come on you to comply the same. However, it is advisable that you go ahead with proper due diligence of the flat through a lawyer and property clerk and ask them to submit title report at the earliest so as to take an informed decision even if there are any disputes pending because at times there are certain disputes which are completely sham in nature. A.It is always advisable not to invest in any property which is disputed since the transaction undertaken will be subject to the outcome of the litigation but if you are getting a golden deal and is very keen to buy the property then you should get the case details evaluated by a lawyer to find out the nature of the case and what can be the possible outcome and how an adverse outcome can affect you to take the final call.

For a title search and due diligence, contact a lawyer. If the property is in fact in dispute, it is recommended that you do not purchase it.

Contact a lawyer for doing a title search and due dilingence. If the property is indeed under dispute it is suggested that you refrain from buying this property.
