I am married and have a son of 2 yrs. My wife suffered brain injury due to high Bp during child birth and then i spend a goof amount of money to cure her. But unfortunately her mind is not responding yet. Only a slight movement of hand and legs are there. Now i have found a girl who wish to marry me accepting my situation. I am not sure if i could marry her or not as I feel divorce on the ground of illness is not possible. I wish to know if i could at least have a live in relationship.
And also, if i somehow got divorce and marry her then is there any possible problem if by chance my wife get back response?

A.This is life and she is your wife you both have spent happy moments when she was fine thats y we say better half to each other. Put yourself in her situation and ask this question to yourself. Go for better treatment. Go for physiotherapy.

A.The question of second marriage does not arise at all when your first marriage is existing. I would suggest you to take care of your first wife properly and understand her medical condition. If you left her than who will tale care of her ?
Just imagine if you would have been in this medical condition and your wife would have had left you, than what would have had happened. So please take care of your first wife even of you chose to live in a realtionship with girl without marriage

A.There is no question of second marriage when first wife is living. You can choose a live in relationship without effecting or complain from you first wife.

A.Dear Sir,
Such real problems not yet dealt with by the Supreme Court. The law has to be enlarged. Presently you have to get divorce on two grounds 1) non consummation of marriage and 2) medical grounds. The law is as follows,

Non consummation of marriage entitles you to get divorce. Supreme Court Says, "Spouses owe rights and duties to each other and in their relationship they must act reasonably."
A petition for divorce under Section 13 (1)(1-a) and (iii) of the HMA on the ground of cruelty as well mental disorder.can be filed by you.
The Court observed, “Undoubtedly, not allowing a spouse for a long time, to have sexual intercourse by his or her partner, without sufficient reason, itself amounts mental cruelty to such spouse. A Bench of Three Judges of this Court in Samar Ghosh Vs. Jaya Ghosh (2007) 4 SCC 511 has enumerated some of the illustrations of mental cruelty.”...

A.Legally you cannot marry without a divorce. If the other girl agrees you can go ahead with live in relationship.

A.yes. without divorce the first wife second marriage is punishable under ipc for bigamy.
