My mother already received family pension for my father from State Govt of Tamil Nadu. Now she lost her son as well who was the private sector employee. His company offered pension for my mother. is that leagally correct to receive another pension when she already received.

A.Dear concerned,
As you stated that your mother is already receiving family pension for you father from State Govt of Tamil Nadu. Now she lost her son as well who was the private sector employee and his company has provision for pension to your mother. In that case the company is having separate entity than Govt. Scheme for pension. She may receive it. But for 5he sake of self satisfaction you must talk to company HR. Or concerned person all about, bcz you do not know what are terms ane condition for pension issuance.

A.Dear client,
You have to refer the terms and conditions of the pension scheme. If there is any rule not to give pension to the person who already getting pension as a dependent it is illegal. If no it is a legal only.

A.Dear Sir,
Yes, she is entitled for such pension. The mother can receive pension on behalf of deceased son while receiving pension on behalf of her deceased husband. If anything happens then she may approach High Court and save her both pensions.

A.A.Hi,
That depends upon the pension scheme and the terms and conditions of pension. You can refer the agreement and make sure whether it is allowed or not. If it is allowed, there would not be any legal issues.

A.Hi,
Please go through the terms and conditions of the agreement. In most cases getting two pensions from two different organization does not matter and causes no legal issues. But if there is any condition in the agreement which expressly prohibits the same, it is not allowed.
