I am an Engineering College employee. I had resigned from job on 5/4/2021 and got relieved on 31st July 2021. During my notice period employer deducted my 20% of my salary with all employees due to corona pandemic. As I was on notice period is it legal to cut my 20% salary and can I get my deducted salary through court.
The same 20% deduction was done during last pandemic from may 2021 to sept 2021. Can I get this salary deducted too.

A.Hello
Gratuity amount is equal to one fourth of the last drawn basic salary of an employee for each completed six-month period. But there is a condition which you need to full fill. You must have atleast worked with employer for minimum 5 years in order claim gratuity.
Also it would be difficult to get back the deducted salary as the 20% salary was deducted from everyone's salary not only you.

A.Hello
In order to get the gratuity amount you must have completed 5 years with employer. After that you become eligible for gratuity. Also if 20% deduction was done from everyone's salary then if all the people have problem then you could combinedly file a complaint against them.
