Supreme Court Of India in an order said that – If a reserved candidate has availed any relaxation on the basis of his category,he/she cannot seek to be accommodated in/or migrated to the general category seat.
A reserved category candidate will occupy a general category seat if his/her ‘merit’ is greater than the lowest ‘merit’ in the general category.
Now the fact is – In a recruitment process (Academic + TET marks + interview = Total marks),and the interview is still due.
Many reserved category candidates have enlisted in the interview list( a list according to which interview is to be taken)as their (Academic+TET marks) are higher than lowest general category candidate.

But I think According to SCI order the ‘merit’ means the Total Marks,that is, all marks are allotted and after whole process completed – if a reserved category candidate’s total score is higher than the general category candidate then he will occupy both general & reserved seat,on the basis of which counselling for choice of school will be done.

Now,my query is – can a reserved candidate occupy a general seat if number in interview ( or number of any one of the complete process) is still to be given ?
Or, a reseved category candidate will occupy general category seat when total ‘merit’ is higher than the general candidate ?

A.Hi,
If any person belonging to reserved categories is selected on the basis of merits in open competition along with general category candidates, then he will not be adjusted towards reserved category, that is, he shall be deemed to have been adjusted against the unreserved vacancies. It shall be immaterial that he has availed any facility or relaxation (like relaxation in age limit) available to reserved category. There is no law prescribing reservation for general category candidates in public employment and therefore there's no question of reserved category candidates being selected against “their seats”.

A.Hi,
There is no law prescribing reservation for general category candidates in public employment and therefore there's no question of reserved category candidates being selected against “their seats”.

A.Dear client,

It is open to all irrespective of the caste, gender etc.
Nothing will happen. Your job will depend on your credibility, and it wont affect you in any way that you filed through open category instead of Schedule Caste Quota, regardless of whether you have a Caste certificate or not.
