Can i file a case against a company based in Noida from Mumbai?

I am in Mumbai, was working for company in Noida(WFH), I have resigned the company and surrendered all company belongings.The company has not yet paid previous 3 months salary. How do i file a case against the company from Mumbai. I went to labour commissioner office..they told that the i cant file complaint for company based outside Maharashtra

You have to file a case from the jurisdiction of your company, you cannot file it via your current jurisdiction.
For the time being, you can send them a legal notice by contacting an advocate. If not agreed then you have to file a suit, from the jurisdiction of your office branch only.

You should first send a legal notice to the employer demanding that all your dues, areas and benefits are immediately settled. if they do not comply, then you need to file a complaint in the office of the labor commissioner in whose jurisdiction your company office in which you worked is situated.

A.Hi,
The compliant has to be filled in the labor commissioner office in which the branch of the company you worked is located. However, it is advised that before filing the compliant you can send a legal notice to the company demanding that your dues and arears be paid at the earliest.

A.If you wish to file a civil suit ( Money suit) to recover your money then you can file it from your place of residence else it will always be possible to file a case in the city where the company or its branches are located.
