Hi, my husband expired recently, we have family disputes in court still pending, and he has illegal affair with other lady and he mentioned her name as wife in bank nominee details. Can i fight legally for the balance amount and savings account insurance amount.

A.Yes you can. You have to give stop payment notice to that Banker specifying that Nominee is not the legal heiress of the deceased person and you have also to specify that as the legal heiress of the deceased person you are applying for Succession Certificate so no sum can be disbursed to that Nominee.

A.Hi,
You can't claim the amount in his account if the nominee is someone else. Only the nominee can claim the amount after the death of the account holder by submitting necessary proofs. However, you can have a share in his properties.

A.Hi,
The bank has to give the amount to the person whose name is mentioned as a nominee by the account holder. You can't claim that amount but you can have a share in his properties if he died intestate.
