hi sir, we have paid an advance of RS 8,10,000 on oct 2020 , to real estate agent to but a open plot in hyderbad and agent aggrred to complete a regestration after 45 days. by saying false news he has postsponed the registaration for 8 months and said that owner has died on may 2021 and legal hier will take some time, if you need money will return or will check on the other plot. and we demanded for money as he looks like cheater. as he used the money since 10 months he agreed to pay 10,00,000/- as a final settelement amount and given in wiriting on 100 bond paper.

but actually this actual plot owner has died on 2014 and created a forgery copy of his agreememnt and cheated us.

actual owner has wirtten will on this property to some of relative due to his debt. based on will and along with death certificate they have sold to other party.

aafter showing the death certigicate to real estate agent , for this he has given 3 cheques on 10 lakh-1 and 5 lakh -2 as a surity of which are withdrwan IN sindicate bank.

on june 10 th he has given cheques with dated 20/07/2021. as bank has merged in CANARA bank, now bank is not accepting this chequeus.

1. real estate has cheated on us
2. signature foregery for died person

police has filed FIR on cheating and ready for arrest.

will he go to prison ?

with in how many days he will get bail ?

can you pelase suggest how to proceed legally ?

how to get an money back through court?

A.By giving legal notice to that Agent you can file Civil Suit for recovery of that sum. Under Order 37 of the Code of Civil Procedure,1908, as amended up to date,you can file Summary Suit for recovery of that sum together with interest.

A.Hello Sir
Oncy you have filed an FIR in the police station the next police would do is to arrest that person and present in front of the magistrate. Also the offence of forgery under section 465 of Indian Penal Code is a bailable offence and the accused persons could get bail within a month. It would be suggested to hire a good lawyer to fight your case and claim compensation for your loss of time and money and punish the accused.

A.Hello Sir
Once you have registered the FIR then the Police would arrest him and as per the punishment given under section 465 of IPC, Punishment for forgery. Whoever commits forgery shall be punished with imprisonment of either description for a term which may extend to two years, or with fine, or with both. Imprisonment for 2 years, or fine, or both.
