since my birth I was been living with my aunt (my mother's sister). After my mother died in 2014 my dad had done second marriage in 2018. Since my 7th std all my education and day to day expenses is taken by my father before that everything was managed by my aunt from my birth . my father has not even looked to me since my mom's death. Now im 21yrs old and bsc 4th yr student. I want to study further but my father is not helping me financially. He has 2 houses in mumbai (virar , bhainder) respectively and a bunch of property in natives being his son I want my part in his property as the house in mumbai and also my education and monthly expenses until I'm independent.

A.dear client you can file partition suit into court against father . you are major to take decisions on your life. try to complete your study and better way to settle down with proper job.

A.It is very unfortunate that your father never cared for you, but since u are his son and above 18 years of age u cannot claim expenses from your father as a matter of right. So far as property is concerned, u cannot claim from it unless it is a joint Hindu undivided family property. Otherwise, u can get share in it only at the discretion of your father during his life time and in case he doesn't leave a will, you will get share in it as per schedule of Hindu succession act by way of succession certificate.
