I have received E challan for violating 1: Pillion Rider riding in a motor cycle without a protective headgear (helmet) Sec / Under 129 M V act 1988 ( U/Sec 129 MV Act 1988,
kindly, please clarify me the following M.V act 417A which says for Exemption for woman pillion driver

BUT 417-A.OF TAMILNADU MOTOR VEHICLES RULES-
Exceptions in wearing protective headgear (Helmet).— The provisions of Section 129 of the Act providing for compulsory wearing of protective headgear (Helmet) shall not apply to the following
categories, namely:-
(i) Persons who belong to "Meivazhi Sabha" or "Meivazhi Salai" who wear turban while riding on a
motor cycle; and
(ii) "Woman" or "Child" riding in motor cycle as pillion.

A.Hi,
If you are under such exceptions, you can plead it in court. Each state has its own laws regarding this and you can contact a lawyer in case you need any further advice.

A.If Tamilnadu Motor Vehicles Rules provides an exemption then certainly you are not to be penalized when a woman is riding as pillion without a helmet. But before you challenge the challan ensure to figure that they might have changed the rules through some latest/recent notification as almost in all states pillion rider is supposed to wear helmet, even a woman.
