Please suggest me what to do - My brother wife making our family more trouble.My brother works in other country 1 year back she was pregnant and at the same time my father was expired so they return back and left her at there mothers house because of pregnancy...she made everyday horrible to my brother saying he having illegal connection with another girl at last because of her words my brother left job and came here in june from that time,she is with us but everyday she made fight because of small issues ...one day my brother got severe injured and may caused of his death on god grace he is safe. even after that she behaved same...on my father 1st death anniversary she went to there home and blackmailed my brother u should come and take me there if not i will do suicide and i will see how ur father function will happen we are talking with her suddenly her brothers came and began to fight with my brother we filed a case on them and later police suggest us to talk in front of big people for sort out these issue she said ok ok and came to home and started same thing recently i got an audio of her saying i will go there and make him more torture for that torture he need to commit suicide and want to die my brother lost his job once because of this and recently he joined in new company they provided flight ticket along with his wife and daughter but she denied to go there now first she accepted now she denied to go can anyone suggest on this how to handle we want to apply divorce how much compansassion need to pay for this we not even take dowry

A.Dear Sir,
The Indian Married Woman sometimes misusing the Indian Marital laws. If there is any FIR then get anticipatory bail and approach High Court for quashing the same as a preventive measure.

A.Dear Client,
You can opt for divorce on the ground of cruelty. For claiming cruelty you need to prove that cruelty is of such type that in ordinary course no spouse will live with that and in your case cruelty is levelling of false allegation by one spouse on another for having illicit relationship with different person. Supreme court in the case of Naveen Kohli vs. Neelu Kohli said a consistent course of conduct inflicting immeasurable mental agony and torture may constitute cruelty.
The court can ask you to give one time permanent alimony to wife which they think suitable seeing the qualification and job status of wife.
