I ve 36x40 site, the party next has en-couched 6 ft and has sold it to some party, now this has been sold to third party, how do I get back my land

A.If you have all proper documents and maps landrecord of your site then you can approach to court for getting back legally. File case of land recovery and redemption of your land from encroachment.also demand damages for loss.

A.A person cannot sell what he does not have. In your case you may approach Court for declaration and eviction provided your site is capable of identification by survey, which can only be done in respect of approved sites. Even otherwise, if sites in other side is marked, fenced or in occcupation your will be able to prove encroachment..
