मेरा एक मित्र है,, जो मध्यप्रदेश सरकार के अंतर्गत सरकारी कर्मचारी है।।। उसकी शादी अप्रैल 2017 में हुई।।। तब उसकी उम्र 24 साल एवं उसकी पत्नी की उम्र 17 वर्ष 8 महीने थी।। उस समय मेरे मित्र को उसकी पत्नी की उम्र का बालिग होने का ध्यान नही रहा।।
आज वर्तमान में 4 वर्ष बीतने के बाद उसके एक लड़का है और दोनों पति-पत्नी अच्छे से हँसी-खुशी जीवन यापन कर रहे है।।।।
क्या भविष्य में उनको बाल विवाह कानून के अंतर्गत कोई समस्या उत्पन्न होगी????
साथ ही उसने अपना marriage सर्टिफिकेट नही बनवाया।। यदि marriage सर्टिफिकेट बनवाता है, उस समय सर्टिफिकेट बनाने वाले अधिकारी को बाल विवाह का पता चलता है तो कोई समस्या उत्पन्न हो सकती है क्या????
वो अपनी शादी वैध किस तरह घोषित कर सकता है???

A.बाल विवाह निषेध अधिनियम, 2006 के अनुसार प्रत्येक बाल विवाह, चाहे वह इस अधिनियम के प्रारंभ से पहले या बाद में अनुष्ठापित हो, अनुबंध करने वाले पक्ष के विकल्प पर शून्यकरणीय होगा जो विवाह के समय एक बच्चा था: बशर्ते कि बाल विवाह को रद्द करने के लिए एक याचिका अशक्तता की डिक्री द्वारा जिला न्यायालय में केवल विवाह के अनुबंधित पक्ष द्वारा दायर किया जा सकता है जो विवाह के समय एक बच्चा था। यदि याचिका दायर करने के समय, याचिकाकर्ता नाबालिग है, तो याचिका उसके अभिभावक या अगले मित्र के माध्यम से बाल विवाह निषेध अधिकारी के साथ दायर की जा सकती है।इस धारा के तहत याचिका किसी भी समय दायर की जा सकती है लेकिन याचिका दायर करने वाले बच्चे के वयस्क होने के दो साल पूरे होने से पहले।
चूंकि उनकी शादी को चार साल बीत चुके हैं इसलिए उनकी शादी रद्द नहीं की जा सकती है ।
