My brother and I bought two separate plot of land.
My brother make me keep all the deed agreements to myself. As he stays far my husband did all the legal work of the land.
1 year ago my husband breathed his last.Now due to some family problems me and my brother are not having good connection.
He is now demanding for the deed.I am ready to give it but I he is saying that he will not come to my house anymore and is asking to send me the deed through someone's hand to his daughter.I want him to physically come and take his documents back..
How will I do it pls guide...what can I do so that he doesn't blame me for the deed papers in future !!!

A.Dear client,
You are under no obligation to go and give him the deed. You can tell him to come and collet it on his own, or get someone else to collect it for him. Since you are not forcefully withholding his deed, he also cannot initiate any legal action against you.

You are right in this as he must come and collect it from you so that he cannot allege you with any wrong thing in future. You need to tell him very clearly that he got to come and collect the docs or else you cannot handover to anyone.

A.You have to ask your brother to give valid Letter of Authority to the person who will receive the document on his behalf from your place. It is pertinent to mention that if that Original Deed will somehow be misplaced while sending it through some other person to your brother's daughter, then your brother will held you liable and can take criminal action against you,more particularly because he doesn't have good relation with you so this may be a trap on his part.
