Flatmate threatening to take legal action for no fault of mine
2 years ago
My flatmate's bathroom door lock and frame was broken when we left the house. He claims that one of my friends got locked in during a party and that's why he had to break it. I wasn't present in the house when this happened. Now he insists that I share the reparation expenses with him. My point is that 1. I did not break the door 2. He did not make me aware of the incident up until the time of deposit return. 3. It's just his version of the story. He broke the door. Why should I be held responsible?
Now he says he will tak legal action if I don't pay. Does he have any standing?
When two people share a rent it is joint and several liability. Since , your roommate claims the damage caused to him is due to your friend, you will have to verify the this. If it is the case, then you will be liable to pay damages for the actions caused by your friend. But since your roommate was negligent enough to not bring into your notice the whole act instantly, you are not bound to pay any damages. This shows that the roommate didn't care enough until the tie of deposit came, hence it will not come under your liability.
Thank You
A.Dear Sir,
Let him take legal action against you as such small and negligible issues may not be entertained by the Courts and if entertained it will take years together to decide.
